Burglary Ends With One Man Dead

11 News has new information about the minutes leading up to a deadly shooting.

We talked to the property owner who says her tenant pulled a gun to stop an intruder.

The shooting happened just after midnight on Sunday at a home near 29th and West Colorado in Old Colorado City.

The property owner says her tenant is pretty shaken up and we know she has not been arrested. The property owner says her tenant is in her mid 60s, and that the man reportedly broke a window and was climbing in when the tenant pulled the trigger.

Linda Orist says her tenant came face to face with a burglar early Sunday morning.

“He was climbing into the window and so she had to defend herself,” explained Orist.

She says the woman was jolted awake when she heard someone trying to kick in the back door. But the intruder couldn't get in that way, so he reportedly went around the side of the house. Orist says she was told by the tenant, that the burglar then shattered a window with a rock and started coming in.

“She came into the room and she said, I'm armed and leave and she fired a warning shot into the side of the room."

When that warning shot didn't scare him off, Orist says her tenant had to protect herself and shot him. Police found the man just a few feet away from the home, in the parking lot at the Mason Jar. He died at the hospital.

Orist says she's grateful her tenant wasn't hurt.

"It's unnerving. I'm just very proud, very thankful she was able to defend herself because it could've been totally different,” said Orist.

If police determine that man was in fact breaking into the home, the tenant will likely be protected under Colorado's “Make My Day” law.

Police are not releasing the suspect's name. We'll let you know when we learn more about the shooting.
